Abstract

This research is about the application of the rule of law in Indonesia in the situation of the state still running the continental European legal system, namely rechtsstaat. Besides also accommodating Islamic law, which has its own paradigm even though the products applied are still limited. Problems: First, how is the application of rule of law in Indonesia? Second, how is the application of rule of law in Indonesia according to the paradigm of Islamic law ?. This type of research is a library with juridical analysis methods. Finding: first, Indonesia applies the rule of law to encourage the national legal system to be not only constitutionally valid, but responsive and become a rule of social justic. Secondly, the application of the legal system in Indonesia does not contradict Islamic sharia principles, because it provides a place for the rights, justice and benefit of the people as the universal goal of Islamic law preserver.
