IJTIHAD MAQASHIDY PERSPEKTIF AHMAD AL-RAYSUNI

Abstract

As the last purpose of syari’ah, maqashid al-syari’ah should occupy significant position as the measurement or indicator of the certain law truth. In other word, understanding the true law should be by understanding maqashid al-syari’ah in right way. Maqashid al-syari’ah is not more than three aspects; they are dharuriyyah (main), hajiyyah (secondary) and tahsiniyyah (tertiary). They are all used as a measurement to create comprehension of living in this world and the hereafter with full of priority to protect religion (hifdz al-din), to keep the wealth (hifdz al-maal). After maqashid al-syari’ah shrinks for centuries since al-Syathibi formulated, Muhammad Thahir Ibn ‘Ashur is back to raise this knowledge as an independent study.
