FIQH BELA NEGARA DAN IMPLEMENTASINYA DALAM KEHIDUPAN KEKINIAN PERSPEKTIF MAQASID SHARI’AH

Abstract

This article aims to explain state defense fiqh related to law and its
implementation in the contemporary era from a maqasid shari'ah perspective. To
analyze the study above, the concept of maqasid from Bin Bayah's perspective is used
as a reading tool for state defense matters related to law and its implementation. The
results of this research are: first, defending the state, with the consideration that the
principles and foundations of the state included in Pancasila and the 1945 Constitution
have covered maqasid shari'ah, and the state as an instrument that will implement
maqasid shari'ah, then defending the state has legal status becomes mandatory for
every citizen (lil wasail hukm al-maqasid). Second, the significance of the
contextualization of maqasid shari'ah as a response and solution to existing problems
stems from a shallow, partial and incomplete understanding of religion, education and
economics. A comprehensive, holistic understanding of these three things will give
birth to a social attitude that is moderate, harmonious, tolerant, mutual cooperation
and just. All of these attitudes will strengthen and strengthen the components of society
while strengthening national defense.
