Abstract

From research by the author discovered the following things first : Syirkah mudharabah or working system aggrement between ship owners and fishermen tend to be capitalist bourgeoisie much favored groups or among bosses and less favorable to the proletarian groups or fishermen. Second: The profit sharing system between the ship owner and fisherman does not meet the principles of Islamic law. The distribution system does not fulfill the sense of justice, the ship owner tends to exploit and control the fishermen. This tendency to master becomes even stronger because of the helplessness of the fishermen caused by the low level of education, low economic level and binding loans, lack of legal knowledge (the islamic and positive law) so that it loses power, especially in obtaining the distribution his rights as a member
