IZIN ISTRI SEBAGAI SYARAT KEWENANGAN POLIGAMI PERSPEKTIF SOSIAL-HISTORIS
Abstract
The change of place, time and the reality has demanded the change of fiqh prevailing in society. The contemporary era has shifted the polygamy law which was eased to be complicated. Polygamy in this article means husband who marrying more than one and four wives at most, at the same time. Polygamy has been done before our prophet Muhammad Saw era and the interpretation of the verses explains it, has changed in accordance with the change of time. The scholars do not forbid the polygamy, the fact, it practice is complex with some of requirements that must be met for instance, wife recommendation. In Islamic countries, the interpretation change of polygamy verses since the first to contemporary era is different with the real dhahir nash. One of the causes is social change for example, Westernization when the Western nations colonized Islamic countries and the expansion scope of modern women to show their capability.
