Abstract

The practice of saving and borrowing in BUMDesa Kluwut Village involves the element of interest, which is considered haram based on Islamic teachings. This transaction has the potential to have a negative impact because it contains elements of Riba. However, a card or savings and loan contract is considered valid if it meets certain pillars and conditions, including muqrid, muqtarid, ijab kabul, and qard. The parties involved in the qard contract are the leaders of BUMDes (as lenders) and the people of Kluwut Village (as borrowers). This agreement was made orally and in writing in the absence of witnesses. In the future, it is recommended that BUMDes switch to sharia-based institutions. This is an important step to ensure that the practice of savings and loans in this village is by sharia principles and can provide maximum benefits to the local community. In addition, this change can also help reduce the negative impact of transactions containing elements of Riba. Thus, the people of Kluwut Village can take advantage of these savings and loan services more safely and by the teachings of their religion.
