Analisis Akad Wakalah Bil Ujrah Pada Jual Beli Hasil Pertanian Holtikultura di Desa Gadungan Kecamatan Puncu Kabupaten Kediri Dalam Perspektif Hukum Ekonomi Syariah
Abstract
One of the livelihoods of the community in Gadungan Village, Puncu District, Kediri Regency is farming. Most farmers in Gadungan Village do not directly sell their agricultural products to the market, they prefer to represent other people who are experienced in selling agricultural products in the market to sell them and will be given wages from the results of the sale. This method was chosen not without reason, but according to most people in the village, people who are not used to selling in the market will be deceived by the price agreement that occurs in the market.
The purpose of this study was to determine the practice of wakalah bil ujrah in the sale and purchase of horticultural agricultural products in Gadungan village, Puncu sub-district, Kediri district and to find out the Review of Islamic Law on Buying and Selling Practices. This type of research is descriptive qualitative research. The data analysis technique used in this research is an triangulation. The results of this study are the practice of buying and selling horticultural agricultural products as follows: first, the farmer will look for people who usually sell agricultural products to the market and have an honest nature according to the farmer, then the person will come to the farmer's land according to the agreed time to take the harvest for sold to the market without a price agreement, a maximum of the day after that the person will come to the farmer to give the money from the sale after deducting the wages according to the agreement that has been determined at the beginning and proven by a note on the results of the sale in the market. Therefore, from the results of the research that the researchers did, it can be concluded that the provisions of Islamic law on the practice of buying and selling with Wakalah Bil Ujrah in buying and selling horticultural agricultural products in Gadungan village, Puncu district, Kediri Regency are in accordance with the terms of buying and selling with Wakalah Bil Ujrah and have fulfilled the pillars and the terms of the sale and purchase with Wakalah Bil Ujrah itself.
Salah satu mata pencairan masyarakat di Desa Gadungan Kecamatan Puncu Kabupaten Kediri adalah bertani. Kebanyakan petani di Desa Gadungan tidak langsung menjual hasil pertaniannya kepasar, mereka lebih memilih mewakilkan orang lain yang berpengalaman dalam masalah menjualkan hasil pertanian dipasar untuk menjualkannya dan akan diberi upah dari hasil pejualannya tersebut. Metode ini dipilih bukan tanpa alasan, melainkan menurut kebanyakan masyarakat didesa tersebut orang yang tidak terbiasa berjualan dipasar akan tertipu terhadap kesepaktan harga yang terjadi dipasar.
Tujuan dari penelitian ini adalah untuk mengetahui praktek wakalah bil ujrah dalam jual beli hasil pertanian holtikultura di desa gadungan kecamatan puncu kabupaten kediri serta untuk mengetahui Tinjauan Hukum Islam terhadap Praktik Jual Beli. Jenis penelitian adalah penelitian kualitatif diskriptif. Tehnik analisis data yang digunakan dalam penelitian ini adalah triangulasi (gabungan). Hasil dari penelitian ini adalah praktek jual beli hasil pertanian holtikultura sebagai berikut pertama petani akan mencari orang yang biasa menjualkan hasil pertanian kepasar dan mempunyai sifat jujur menurut petani tersebut, selanjutnya orang tersebut akan mendatangi lahannya petani sesuai dengan waktu yang telah disepakati untuk mengambil hasil panen untuk dijual kepasar tanpa ada kesepakatan harga, maksimal sehari setelahnya orang tersebut akan mendatangi petani untuk memberikan uang hasil penjualannya setelah dipotong dengan upah sesuai dengan kesepatakan yang telah ditentukan diawal dan dibuktikan dengan nota hasil penjualannya dipasar. Oleh karena itu dari hasil penelitian yang peneliti lakukan dapat disimpulkan bahwa Ketentuan hukum Islam terhadap praktek jual beli dengan Wakalah Bil Ujrah dalam jual beli hasil pertanian holtikultura di desa gadungan kecamatan puncu Kabupaten Kediri sudah sesuai dengan syarat jual beli dengan Wakalah Bil Ujrah dan telah memenuhi rukun dan syarat dari jual beli dengan Wakalah Bil Ujrah itu sendiri.
