IMPLEMENTASI MAQASHID AL-SYARI’AH MELALUI FIQH SOSIAL (Mengkaji Gagasan Fiqh Sosial KH. MA. Sahal Mahfudh)

Abstrak

The social fiqh concept by KH. MA. Sahal Mahfud is a fiqh doctrine dynamicization and it is also alternative method implementation of maqashid al-syari’ah in creating society comprehension. The essential of this concept is the relevation of kitab kuning and reactualization of madzhab by fiqh text interpretation contextually, the spectrum alliteration of madzhab from textual (qawly) to methodical (manhajiy), base verification which is main perception (ushul) and which is the affiliation (furu’). Fiqh is presented as social attitude, not as a positive law of country, also the introduction of philosophic thinking method, especially in culture and social problem. Social fiqh concept is an effort to place fiqh as one of doctrinal mainstreams to answer epoch challenge, all at once to do moslem religious emancipation action.
