Poligami Menurut Wahbah Zuhaili Relevansi Dengan Undang-Undangperkawinan No.1 Tahun 1974

Abstrack:Marriage is a sacred and strong bond between a man and a woman, a marriage is said to be valid if it has been agreed and accepted, and a couple who has carried out the marriage must be able to maintain the household bond and must be able to live it. The principle of marriage in the Marriage Law No. 1 of 1974 is the principle of monogamy, which means that a man is only married to one woman, but in practice there are not only monogamous marriages, but also the practice of polygamy, while polygamy is marrying more than one woman at a time. Contemporary scholars such as Wahbah Az-Zuhaili argue that there are several conditions for a man who wants to have more than one wife, namely being able to do justice as fairly as possible between one wife and another and being able to provide for his wives fairly and equally. The existing marriage law in Indonesia adheres to the principle of open monogamy, in which a husband may marry more than one wife, as stipulated in the 1974 Marriage Law Article 3.
