Abstrak

The main problem in this thesis is how to resolve defaults in car rental rental agreements from the perspective of a compilation of sharia economic law regarding the form of cooperation that occurs between the rental owner and the lessee. The purpose of this research is to find out what form of car rental rental agreement takes place between the rental owner and the renter, and to explain the resolution of defaults from the perspective of sharia economic law. The type of research that the author uses is a qualitative method or descriptive qualitative field research, namely research that describes the form of settlement of rental car rental defaults from the perspective of sharia economic law. The benefit of this research is that theoretically it can provide information and knowledge regarding the form of rental agreement and settlement. default according to the perspective of sharia economic law. Based on the results of the research that the author carried out, easy steps for resolving defaults in rental car rental agreements in Al Badru Alaina must be carried out with a systematic approach and based on the terms of the agreement. Through clear steps, starting from identifying problems to resolving them through mediation or legal channels, it is hoped that default problems can be resolved fairly and effectively. Prevention is also an important aspect to reduce the possibility of default in the future.
