Kajian Fiqh Muamalah terhadap Mekanisme Perjanjian Pembiayaan Modal Usaha Mikro pada Skema Kredit Bersyarat PT PNM

Abstract

This research aims to examine the implementation of the conditional financing agreement applied by PT. Permodalan Nasional Madani (PNM) Mekaar in Pakong Village, Pamekasan, and review its conformity with Islamic law (Fiqh Muamalah). This practice involves providing micro-business capital loans (qardh) to pre-prosperous women, who are required to pay weekly installments over 50 meetings in one year. Customers are also charged a service fee/compensation fee (balas jasa) channeled through the Account Officer. Using a descriptive analytical qualitative field research method, this study found that the implementation of this agreement fulfills the pillars (rukun) and principles (asas) of contracts in fiqh muamalah. From the perspective of Islamic law, the additional charges (compensation/administrative fees) imposed on the customer in the qardh contract are considered permissible when viewed from the perspective of the elements of sharia financing, which acknowledges the compensation (ujrah) charged by the capital owner (PT. PNM Mekaar/muqridh) to the customer (muqtaridh). The researcher concludes that this micro-business capital financing practice is generally in accordance with sharia law provisions
